Our Approach to Litigation
A considered strategy. A prepared advocate. Ontario disputes assessed from your objectives, the evidence and the practical consequences of each next step.

Recovering a debt, retaining control of a business, protecting property and defending a claim call for different strategies. The starting point is understanding what you need to achieve, the time available and the financial reality of the dispute.
Starkman & Zhang Lawyers represents businesses and individuals in Ontario litigation. Founding partner Paul H. Starkman brings more than thirty years of litigation experience; partner Calvin Zhang works in English and Mandarin on commercial and cross-border disputes. For the firm’s background and courtroom record, see About Starkman & Zhang Lawyers.
Make the Evidence Do the Work
A useful assessment tests the strengths and weaknesses of the case. Contracts, correspondence, accounting records and court documents help distinguish what can be established from what still needs investigation. Three questions anchor that first review:
- What happened, and what does the existing record show?
- Which dates, assets or business relationships need immediate attention?
- What information would materially change the assessment?
Consider the Route and the Cost
Court proceedings are one part of dispute resolution. Negotiation, mediation and a focused motion may each deserve consideration, depending on the case. Preparation for court can inform a realistic settlement position.
Before retaining counsel, discuss the proposed scope, who will work on the matter, billing arrangements, the initial retainer and the assumptions behind a budget. Ask how new developments will be assessed and communicated. Our guide to how litigation lawyers charge in Ontario explains retainers, hourly billing and the loser-pays costs rule in detail.
Examine the Record for Yourself
Our case library links to public decisions and explains the issues in selected matters. It is a way to examine the nature of our work, including appeals, construction trials and enforcement of foreign arbitral awards.
A reported decision is a record of a particular proceeding, not a prediction for another client. Outcomes depend on the evidence, applicable law and the circumstances of each matter.
